most schools explicitly require that you mention all arrests including whatever is expunged

this makes good stuff for a PS, berkeley will love you

I would say to talk to a professional ethics attorney in real life, ideally in the jurisdiction you wish to practice in. You always want to err on the side of disclosing, but it seems you have legit reason (from a few perspectives) not to. I'd get formal advice about it either way.

What are the actual chances of character and fitness finding an obscure and old police report? Is it worth disclosing knowing that if I do I will have to provide the awful police report which misrepresents so fully what happened and makes me look so bad? For example, police report says I explicitly mentioned oral sex, which I didn't. I believe I am also entitled to have the disposition expunged. The police report and disposition are the only records that exist.

What do you guys think? Disclose and explain? Don't disclose. Any insight would be appreciated.

And please don't pass judgment and call me names or tell me I am not fit to practice law. I have never had any encounter with the law otherwise, don't drink and drive, or use drugs and am generally a very kind and helpful person.

And at least as far as I know, most schools don't care about getting a copy of the actual police report. Basically a simple "I did X cited for violating Y statute and had to do Z number of community service hours" should do it.

You have a great GPA, it would be a shame to settle for a 169 when you have retakes available.

I wish the world were such that people who found themselves in situations like yours could be open and honest about it and that others' reactions would be more along the lines of mine, i.e. that I respect you all the more for pulling yourself through a difficult situation and still getting to where you are today. You're worth more than a hundred of the silver-spoon types you'll likely get to know once you start school.

That said, if you can make sure everything is expunged, do that and don't mention it going forward. We're not there yet, so do your best to play by their rules.

If its real then I can't see why you would consult TLS but not the state bar of the state you're planning on practicing in.

Was just kind of strange to me, like this person knew all about disclosing for the sake of character and fitness but thought it better to consult the hivemind than actual attorneys. And it's Friday night, thought maybe someone was having some trolly fun.

Nothing good is going to come from consulting TLS on this issue. Delete your post and go talk to a real authority on the issue.

I wish I could say disclosure is a no-brainer, because the last thing you want to pile on the insecurity of going to law school is a potential C&F bomb waiting at the end of 3L, but in this case I don't think it is a slam dunk "disclose, duh." Good luck, and I really hope this doesn't affect your life going forward.

Since you're real, the only possible advice is consult an attorney. This is really serious, even if there was a consensus here on what exactly you should do you shouldn't trust it because these people aren't practicing attorneys for the most part (they're mostly law students) and the price for them (and you) being wrong is very high.

Problem with disclosing is that if you decide you want to work in the private sector and they access your C&F records, top firms won't look twice. Yes it's an unfair stigma, and no I don't think it will change any time soon due to the natural conservatism of the profession and the industries it services. But dealing with the consequences of your actions is part of life.

I doubt it will matter for much in public interest
