I have a first time offense for a misdemeanor for a DUI that only required community service hours..
"2. Have you ever been convicted (without the conviction being vacated) of 1) a misdemeanor for which the sentence was imprisonment, or 2) any other misdemeanor excluding a first-time conviction for drunkenness, simple assault, speeding, minor traffic violations, affray, or disturbance of the peace within the last five years?"
Would you disclose it if you were me? Would it fall under drunkenness and thus exempt me?

Yes, not even a question. A misdemeanor-felony distinction isn't really relevant to the question. People stress out about whether or not to disclose dorm infractions when they ask about academic trouble. This isn't even an issue. C+F would have a field day with this if you didn't disclose. You might have to go to a slightly worse school, but what's worse is going to law school, winning the game and then not practicing.

Yeah i feel you but it says *excluding a first time conviction for drunkenness, etc*... This is a gray area that the admissions officer wasn't quite able to answer for me

Full disclosure is required. ("Drunkenness" is not the same as "driving under the influence" in my understanding. Intoxication is just one element of a DUI offense.)
P.S. Besides, it makes you a more likely candidate for law review.

drunkedness, as in public drunk., i.e., walking the street. Or, busted at a college party while under 21.
DUI ain't even close.

Yes, you have to disclose it. As someone with a misdemeanor dui, I can tell you it hasn't seemed to have any effect on my cycle so far. PM if you have any additional questions.

Duh you would disclose it. That's not even a question. Disclose everything possible. And I have a C&F misdemeanor pending, too. It hasn't been the factor that's affected my admissions cycle. Not disclosing will hurt you much more than being honest.
