Hi there,

I just received an unlawful entry of subway summons. I wasn't thinking and followed the person in front of me through an emergency door. Cops immediately gave me the summons. It was not my intention to skip the fare. I own an unlimited Metrocard (i.e., I don't need to hop the turnstile).

1) How badly will disclosing this impact my fall 2011 application?

2) Should I contest the summons in court (on the grounds I own an unlimited Metrocard and should have unlimited monthly access to the metro)?

Bring unlimited metro card to court as exhibit A.

In DC, evading metro fair is a misdemeanor. I don't know what is in NY or wherever you are, but you should probably disclose and not worry about it because nobody cares.

1) Disclose and nobody'll care. You are fine for admissions.

2) I cannot give legal advice, as is the case with most people on this forum. But if you go to court, you might have to write a little note about it depending on the school. I had to write about my traffic court appearance for University of Minnesota and Lewis and Clark. That's not necessarily a bad thing though. It's another place that you can attempt to influence the adcomms.

Shit, I dropped my farecard like a noob one time and the metro employee told me to just go on and not worry about it

I got a fare evasion charge on the Muni a few years ago. I paid, but I just moved to the area and did not know that the turnstile issued a receipt that I needed to take. I disclosed it in all my applications, and I don't think it hurt me at all. I only got one rejection, and I think that Stanford probably rejected me because of my 3.62 GPA, not because they think I am a criminal.

arguably one of the most minor offenses you can commit. No one will care, include that bit about the unlimited metro rides for added lulz for adcomms

Did you show the cop the unlimited fare metrocard at the time? What did he say?

Does the summons classify it as a violation or a misdemeanor?

If it is a misdemeanor, I would probably contest it just so you can try to avoid having a record of any kind. If you can show you had an unlimited fare metrocard, but of course be prepared to prove that it was yours and you did not simply buy one after the fact or borrow it from someone else. If you paid by credit card bring a receipt showing you paid for it on a given date.
