Should I apply at this point or just wait until November?

All of the schools I am applying to had an application deadline of May1st although if it happens to fall on a weekend, it gets pushed to the next business day. Now, I really have little hopes of getting in to my top schools 1) because my LSAT falls a few points below the median, 2) because the same can be said for my GPA, and 3) I have a great story to tell on a personal statement and diversity paper, but I haven’t given them the proper attention and time necessary (I am an URM). Now I can apply now and give it a BS attempt, and just have my name out there, wait for next cycle and re-apply with a much better application. Or I can just wait and give them one good attempt with a stronger application, and also an expunged record for petty theft (doesn’t have to be released to some schools).
It seems like choice number 2 is the best, but perhaps schools want to see how much I wanted to get in and waited a year and vastly improved my application?? Also, if I apply now, I have to release the fact that I was arrested (but I can spin it somehow and say it could have been expunged but I wanted to disclose it?) I feel like doing the first mostly because I don’t want to regret not having at least tried to apply and because everybody expected me to apply, it would be a disappointment.
