I'm almost positive that California is like Texas in that they both require public schools are either 75% or 90% (I forget which number) is from in-state applicants. That's one reason that both schools are so competitive: out of state students are vying for a very limited number of seats.
I'd say you have a decent shot at admission. Who knows if there will still be scholly money available though?

Not sure about Berkeley, but Texas is limited to 35% out-of-state students.

Their FAQ says it's roughly 50-50 admitted, so all you need to do is find the % OOS & IS applicants and compare.

Being in-state doesn't help.
Berkeley has a lot of Californians because Californians want to go there, not because of some strict ratio (such that UVa has). Being a resident helps you get into UVa, it doesn't really help you at Boalt.

Glanced at the subject, thought it said, "Does being insane help at Berkeley?"
..sorry to contribute nothing to the thread.

Just so it's all official and stuff:
http://www.law.berkeley.edu/47.htm#Q3
ETA: Ironically it is the second link when doing:
http://lmgtfy.com/?q=does+being+in+stat ... t+berkeley
I didn't even have to type "Boalt" or "law," just "Berekeley."

3.9/171 shouldn't stress.

I generally don't post on "What are my chances/choices" questions because I don't know anything about that, (having gotten my J.D. in 1986) but in this case, I wonder whether the OP has applied to Stanford? Absent financial aid, I believe that out-of-state fees (tuition) at UC Berkeley total more than Stanford tuition and Stanford is the better school.
