I've been looking into Cornell obsessively over the last few days and sorry to say there's very little info on LSN for a 3.9/165 splitter. It's worth an app though but looks like WL territory.

No idea what your talking about. If you retake the LSAT and score a 172 or better (that is above their 75th%) then you will be considered for scholarship money. They do consider people with ED and if they screw a 3.95 with a 172+ with no scholly money that would hurt them because they know people will see their "we evaluate everyone equally" as bullshit. Im sure thats not something they want to do. You may not be evaluated equally, but if you have numbers that are rediculously high then yes you will get money.

If I re-take in December, how does applying now with my current numbers (3.9, 165) affect my chances if I get a 170-174 on my next LSAT? Will I have to re-apply or something?

This is hard, because right now your early in the admission cycle. That will help you. After getting your score back in december you are going to be very late.
