Texts/emails/etc can be deleted, so without a forensic analysis of the phone, absence of obviously-incriminating records probably wouldn't tell you anything conclusively.

My favorite was the cheating in a casino addition to the back story around page 3(ish). The 0L legal analysis has just been the icing on the cake.
