This is the passage about Thurgood Marshall. Could someone explain why is E incorrect here?

First off I will explain why (D) is the correct answer. Throughout the second paragraph the author talks about how Marshall would proceed against the "separate but equal" doctrine. The author explains that Marshall would use the earlier approach in the short term and eventually it would lead up to using the theoretical approach to prove the first contradictory. So this fits (D) perfectly as it would be a gradual convincing of the courts to repeal the doctrine.

Answer (E) which states that Marshall has a preference for practical goals is actually the opposite of what we want. Practical goals would concern something that is concrete and not something that is theoretical, abstract or imaginary. The words practical and theoretical are actually antonyms.
