it could only be assault. for intentional torts the "intent" simply needs to be voluntary. also if i remember your hypo correctly it was for NIED, which needs damages, which according to your hypo is absent.

what i always found interesting about this case was that scalia dissented, i don't know why he did, but damn thats cold.
