Thanks everyone. Found a little motel 25-30 min away from the convention center. I'm sure it wont be comfortable but it beats having nothing

Oh my gawd. I'm going through civ pro deadlines (like the amount of days required for each type of stupid filing, etc.) and drinking beer. And the beer is winning, you guys.

Mixed sets are better anyway. Totally good for confidence, at least compared to most of the MPQ sets.

Despite a rocky start to one earlier today, I have to agree that those are a huge confidence boost. Additionally, I have found that I can fly through those things. If the test is anything like those questions, I think we are all in pretty good shape.

For those that defied all logic and attempted MPQ6, did you think they were actually harder than MPQ5? I am somewhat surprised that I am doing better on MPQ6 than MPQ5 (relatively speaking), and I've done all of them except Property so far (which I heard is miserable anyway).

Nah, I thought 6 was easier as well. Property of course being laughable/headache-worthy.

I thought MPQ5 was harder than MPQ6. But I still missed several because I'm tired of the MPQ sets.

Haven't done property either but I also thought 6 was easier. I'll assume we've all just gotten much smarter.

I did the BARBRI Half Day yesterday and it seems the consensus is it's brutal.
I'm doing the BARBRI Full Day A.M. session today. Is it supposed to be harder or what? Plan on doing the P.M. session tomorrow or maybe just two mixed sets instead.

definitely did better on MPQ6 than MPQ5 - not sure if it was because I paid extra close attention after I was blindsided by the difficulty of MPQ5 though.

Barbri MPQs break me down and then Emanuel S&T builds me back up

Though I got the answer right, I don't understand why the answer was what it was:

Chosen venue = Fed Ct SD A

Defendant 2 includes Motion to Dismiss for improper venue with his timely answer. What should court do?

Answer: "Grant the motion because the motion is timely and venue is improper." I picked this because it was closest to being right (it at least got the reasoning right). But shouldn't the court be denying the motion and transferring to ND of state A (where the accident occurred) instead since that's the only place where venue is proper and no facts point to an injustice by transferring?

I think it must be because it's in the court's discretion on whether to dismiss or transfer--like even though it makes the most sense to transfer, the court could choose to just dismiss without prejudice and since none of the other answer choices were correct, we're just supposed to go with that.

This is right. But interestingly, there was another question (either Barbri or Adaptibar) where both dismissal and transfer were answer choices, and it said that dismissal was wrong because the court should "ordinarily" transfer if possible.

For those of you using Critical Pass flashcards ---

How much of these cards are you really committing to memory?? There's some subjects (like Con Law, Crim, Ks) that I'm able to memorize the majority of, but on like, Civ Pro, for example, this shit is WAY too detailed for me to be able to remember.

Just curious if I'm like an idiot or something for likely not knowing on Tuesday/Wednesday that an appointment of a receiver is an interlocutory order reviewable as a matter of right, etc.

well that did not go well. I'm usually in the 60s but today I've been tanking- 48%. I can't tell if I need a break or need to go nuts studying because it's my only chance at passing.
