I don't write out essays anymore, takes too much time. But they do serve as good reviews to see if you can correctly restate the rules. So outline them if you are so inclined.

+1 to outlining.

I haven't encountered a single essay that I don't believe I can write out in 30 minutes... identifying the law to apply is the name of the game.

The best part of her introduction video is where she advocates using a grid on a piece of scratch paper to keep track of medium and very difficult questions. Thereafter, she explains that...."you aren't allowed to have scratch paper on the bar." :roll:

Haha, she said to use the cover of the booklet as scratch paper or something. But then you'll have to flip back and forth just to implement "the grid." Yup, not going to happen.

I've done a couple of these and they do seem harder.. a bit hard to explain why though. In general, the questions seem longer and the jurisdiction questions seem to hinge on smaller issues that weren't tested frequently in the BarBri Civ Pro questions.
Have you done the 10 NCBE sample questions. They're easier, IMO, than Barbri. That said, they are different. There was one person reporting that the actual game day questions seemed harder than these samples, but who knows.

I've done all the assigned sets so far which is seven of sets 1-5 and three of set 6 (684), all online. Plus I've done the full day, the refresher, and two mixed sets (400). The Barbri progress page shows me as having done 671, which, while an odd number that doesn't fully make sense, would point to the progress counter only counting the subject sets of 18 and not the mixed sets, practice, or refresher.

ETA: The theory is that a search incident to arrest is meant to protect police from weapons secreted within easy reach of the D (or people hiding waiting to jump out at the cops -- but that's for arrests in a house). If the person is already secured, there is no longer danger of them getting to a weapon in the passenger compartment.

What helps me remember that is Scalia arguing that it creates an incentive to leave suspects unsecured.

It's not like it's impossible to implement Sambito's grid approach without scratch paper.
Just have a code or something where you circle or box the question number. For example, put a check by the question if you don't want to come back to it; circle the question number if you want to come back to it on your first pass; box the question number if you want to come back to it on your second pass. I forget her exact one check-two check system but I think it's something like that.
C'mon guys. It's a fine strategy if you do the questions fast and anticipate having extra time during each 3 hours session.

Yeah, or the scenes from cop shows where the suspects have their hands on the hood or the roof, but are uncuffed while police search the car.

When they have probable cause to search the entire car, then it falls under the batmobile exception instead of incident to arrest

When they have probable cause that the vehicle contains some form of contraband or evidence. For example a reliable informant tells police that he saw the suspects load drugs into the trunk. Basically, if the police have enough information to support them going to get a warrant to search the car, they can search the car.

ETA: Always bear in mind, though, that the scope of the search is limited to places where the contraband/evidence could be. For example, if the informant told police that he saw suspects load a bunch of stolen shotguns into the car, they can only search in places large enough to hide a shotgun.

One thing to keep in mind is that there will be more jurisdiction questions on the real thing which is arguably easier than having to remember the details for the motions, discovery, etc...

That came up in one of the first question sets. I feel like subsequently there was an exception to the exception, but I can't remember what it was (if there was one) so I'll just hope that it comes up strictly as option + leasehold on the MBE.
