By the time they got to property, they may have just given up on Barbri MPQ questions and gone to Emanuel. I'm doing Emanuel MBE questions instead of sets 5 and 6, even though its giving me anxiety seeing my PSP completion rate fall below average.

Hi guys,

In these last two weeks, how are you memorizing? Are you using Quizlet or any other online tool? Or making/using physical flash cards? Or just practicing?

I just went through flashcards for Con law and Secured Transactions today, whew, it took me 8 hours total to "roughly cement" the most relevant stuff inside my head and even after that I feel slightly shaky on those topics in terms of writing out volumes for rule statements.

I'm basically reviewing my outline and then quizzing myself on the big topics. I just grab a blank piece of paper and write out every intentional tort and every element. Or when the SoF applies and the ways to satisfy it.

Anyone have a good list of things that count for "on the merits?" Like if a party fails to show up to court and they get a DV against them...merits?

So here are the ones that Barbri said are NOT on the merit:
  • Judgments predicated on procedural grounds (i.e. misjoinder, venue, lack of jurisdiction, etc)
  • Statute of Limitation
  • Plaintiff's lack of capacity
  • Failure to state a cause of action is NOT on the merits if P can amend to state a cause of action
These are ON the merit
  • Default Judgment
  • Consent Judgment

I am reviewing each outline, sketching out answers to essays and grading, reading model answers, reviewing outlines, doing more essays. I think it is best to pair subjects that are related (ex. Agency with Torts, Crim law with Crim procedure, Wills with Trusts, Administrative law with NY practice, Domestic relations with PR, etc.).

Just curious, is NY PR not the same as what was tested on the MPRE? Or they just want to ensure that NY lawyers are extra ethical.

MPRE is multistate PR and there are some state specific rules (for instance, NY lawyers have to post in office a list of rights of clients, and verbally inform the client of them in a domestic relations case). But yeah, wtf I thought I did this already!

Yeah. VA has a professional ethics essay every other exam. I don't see the point when we barely have any state-specific rules.

oh man...is secured transaction that big in your state? I don't know if that was worth 8 hours (not trying to criticize, just pointing out for the rest of our time)... :oops:

That's basically what I've switched to. I took a big eraser to my calendar this morning after my now-normal shower cry. There's no worse feeling than studying something and then going back to it later and realizing you're blanking out on the essays. Initially, I had decided to hit a couple subjects hard and then sprinkle in some review of other subjects throughout the day. However, when I start thinking about all the subjects like that I feel like just burying myself in the backyard. So, I'm going to focus like my two subjects for the day are the only ones on the bar. I'm having a rough time switching from subjects like Torts/Contracts to Civ Pro.

I'm only doing flashcards for the arbitrary stuff and things I don't have enough experience with to recall enough. Today it will be mostly Civ Pro--just one card for each of: "where is venue proper if...", "When must you file a motion to X?", and "What is a motion to Dismiss?" or "Summary Judgment?" It seems pathetic but my brain is failing me and I've reached the point where after I read an essay question I'm not sure I could even remember my own name.

Showed considerable improvement on my MBE refresher just now. Got 104/200 on the midterm, but got 69/100 so quite a big jump. Got solid scores on 4 subjects, decent on 2, and then got destroyed by Property (5/14).

Gonna watch the video analysis for the 3 not strong subjects now. Will see if they're worth the time.

Ummmm well this is embarrassing, but I apparently did the wrong test. I did the half-day exam, not the refresher. Make sure you do the refresher in the gray pages.

Whoops. Oh well, I'm gonna leave my score as is. Makes me feel better lol.

What is the "Refresher" ?? why is it named that -- anything special? when are you supposed to do it?

It's at the back of the MBE book (if you're in an MBE jurisdiction I assume). My state was never assigned the half-day exam, which is also 100 Q's, so I figured that was the one I was supposed to do. Nope.

Same, IL never assigned the half-day exam or the "full day" (not the simulated MBE), so we can do it if we choose to.

Yea I see it, but is it any different than the mixed sets? Is it called "Refresher" just for fun?

Yeah I guess. Definitely a mixed set and then there are analysis videos for each topic. Don't know what the difference is for difficulty or anythiing, although a quick glance through, it does look like the questions are a bit shorter. Maybe it's supposed to be a confidence boost from BarBri. Someone else who has done it will have to attest to that. I'm not doing another 100 questions today lol.

I'm struggling with identifying if a statement actually being offered for the truth of the matter asserted when doing MBE Qs. Are there any tricks for identifying when the statement actually being offered for the truth or some other purpose?

The "trick" I was taught was that: assuming the statement is false (not that the person never said it, but that whatever was said was not true), would the party still want to offer it.
