Has/will barbri post an "average passing score"? Or is the general standard that anyone over 100/200 is in decent shape?

I know people who got low 90's on simulated MBE and got 135+ on real MBE. I know someone who got a 140 after getting a 73. I also know someone who had a 38 (LOL) on the simulated and passed the Bar.
I suggest critical pass to people struggling. Just make sure you commit to studying a topic or two a day, really understanding and memorizing, and then doing practice MBE questions on that topic. Since it is a little late in the game, I suggest also doing a NY subject at night as well. If you stick to this and don't half ass it, you'll be fine.
Thanks for this, really made me feel semi decent. Honestly was probably a little too cocky in thinking the answers would just "come to me" when I was taking the test. Time to start memorizing, thanks for the support!

Doing domestic relations today. I have the guy who doesn't even give a lecture handout, so I'm just outlining from CMR. I'm just realizing how horribly organized the CMR is for state-specific subjects.

Has anyone watched the MBE review videos? I have been just checking the back of the book for the workshops. Trying to determine if that's what I should do for the simulated MBE or give these videos a second shot.

I watched one and didn't think it was worth it because I always go back and read the answer explanations anyway. For some reason NY puts several days of actual work in between the midterm and the review lectures. By the time I went back to the test I'd forgotten why I picked what I picked, so they were useless. Any advice for learning detailed/new state specific topics? The only essay topic that is completely foreign to me is Commercial Paper and I'm having a hard time wrapping my brain around it. Curious as to how other people are approaching similar issues.

"Here's my best attempt to explain Commercial Paper:
I think the hardest thing to get a handle on is what the disputes are even about and who they're between. Basically, you want to proceed in this way:
1. Who is suing whom, exactly? (Is the bank that had to pay the check the one suing? Is someone who unknowingly indorsed an invalid check pissed off? Is there a thief getting sued, or are other people getting sued for indorsing a thief or taking a check from a thief?)
2. Are they suing over a negotiable instrument? Apply elements of a negotiable instrument. If it's not a valid negotiable instrument, then your Commercial Paper problem has officially ended and the plaintiff will need some other type of action, such as a contract breach.
3. Is the plaintiff (the person suing because they got screwed) a holder of the instrument? (Does the plaintiff have a right to sue over the instrument?) Apply elements for a holder. (In plain English, it's not like I can pick up a check off the sidewalk that was written to someone named Timothy, and sue on his behalf. I have to be a valid holder of the check. This usually means I paid value for the check, or someone wrote it out to me, or someone who was a previous holder indorsed me on the check.)
4. Did the person sued do anything -- i.e. sign, create or guaranty (warranty) anything -- to make them accountable to the plaintiff? In other words, did the defendant sign, create, present or indorse a valid negotiable instrument and give it or cause it to be given to someone else?
5. If yes, does the defendant have any defenses or waivers against being held liable they can make? (Make sure they didn't waive liability in the indorsement of the check. Meanwhile, fraud in the factum and fraud in the inducement are going to be the most common defenses, especially if a thief is involved. But remember, there are two types of defenses, and the distinction between them matters.)
6. Is the person suing them a holder in due course? (This matters because it limits the defenses; fraud in the inducement is the big one that doesn't apply to protect you when the plaintiff is a holder in due course.) Apply the elements to HDC status, the most important being: did a valid holder give value for the check?
7. Okay, so the defendant's getting sued and has no defenses that apply, either because the plaintiff is a HDC that limits his available defenses, or because the plaintiff is just a regular holder but no defenses of any kind are applicable. But can the defendant kick liability down to someone else? (Ex: A presentment warranty is typically violated by the person who presents the non-payable check to the bank, so the presenter is the first to get sued, but they may in turn have an action against the person who transferred to them the check, and that transferor may in turn have another action against a previous transferor or perhaps the drawer of the check.)
Review one of your previous or current Commercial Paper essay problems, and try just issue spotting for an issue involving one of those seven steps. Hope this helps."

I think people who didn't bomb and reached somewhere near what they were hoping for should take a breather. I'm doing the lectures today and tomorrow, while I type up what I got wrong, then maybe doing an essay or two. I'm going to the beach tomorrow morning, and I may just cover up alcohol in brown paper bags because now I finally understand why cops can't check the contents of my drink short of probable cause. Friday I start killing state-specific.

I did about 50 of the mock MBE questions yesterday before it became too painful. Checked my answers. Got 26/50 (52%).
In the last few days I've also done 224 real questions from Emanuel's, with 160 correct (71%). It says you need 61% to pass in an average state like mine.
Wouldn't say I'm in great shape, but it is more evidence that you can reasonably expect your raw on the real test to be about 20% higher than your Barbri %.

Haaa, yeah I took the simulated MBE without touching crim law/pro or civ pro (besides watching the lectures/filling out the lecture notes). It made me feel better that my score was still alright without knowing much of anything about those topics. For the MPTs, do you usually read the cases first and then the facts (what barbri lecture generally said) or other way around? I did it this way for the assigned MPTs and the simulated, but it seems to be that this is not very efficient because then I have to go back to the cases and pick out what I really need. Has anyone found it to be better to read facts first?

Mixed Set question --
I got 27/50 on Mixed Set 1 last night and 38/50 on Mixed Set 2 just now. I'm a little skeptical to believe I got smarter overnite (tho wouldn't that be awesomeeee!!!)
Other's have similar results so I can assume it was just a way easier set?

I agree it's much more manageable than CMR. I like that they're in physical little pieces, so I can set aside the concepts I know and create a pile of my "problem areas" for dedicated study.
