Yeah I think I got it wrong.... It was about admission of remedial actions as evidence of.... Can't remember what... If it's for liability its inadmissible, but to prove there was a safer known alternative its admissible.... I think :?

Well I don't think were allowed to say any specific facts and id rather keep this thread open. but i think i said inadmissible, when i should have said admissible. fl mc was a blur to me.

Like how highly personal? I haven't been having my normal amount of bowel movements so I want to be able to identify myself. Maybe I should amend my bar app? I believe bowel movements was right after employment history. Thanks for the help!

Did the police have an exigency circumstance to enter the house because they heard a disgruntled "moan." Argued both ways. ANOTHER ethical issue here, crim attorney working for a contingency fee.

Yay this is a good write up...I definitely didn't do enough on essay 2 but I did decent enough on the rest and all ethics issues to the extent that I'm not that worried about my essay score.

The mbe, however, is making me worry

It's a sad situation when I know if I passed that means many of my guesses (mbe and state) were right and if I failed then my guesses were wrong. Cheapens the whole deal for me.

Lots of issues with the all three ethics questions so a quick breakdown on what I discussed:
Question 1: whether the attorney can take a proprietary interest, if so whether the interest as a fee would be considered excessive
Question 2: Compensation by a third party, contingency fee in crim case as well as excessive fee. Also argued the bonus as a gift to attorney that couldnt be accepted
Question 3: contingency fee being excessive (outside the guidelines). Fraud/misrepresentation for calling 50% a standard attorney fee when it was clearly excessive, and Failure to withdraw; argued attorney would try to recover for work he did over several months but that he should have withdrawn at the wish of client

in all excessive fee analysis I discussed fees in general. I felt like there were a lot of points to gain on the Ethics portions of these questions and i "think" I hit the main points pretty well. Anyone find any other issues?

I think I totally shit the bed with my essay answers; spent all that time practicing form/language/etc., then just shit everything that popped into my head onto the page. Not that much popped into my head.


I've got this ominous feeling that the only way I pass is if 30% of people were even stupider than me.

I feel the same way - so I suspect many more are in the same boat, which is a good thing.

Spent so much time on Essay #1 that form/language kind of went out the window on #2 and #3. (moreso #2 because I was not expecting it at all).

I could not imagine studying and working at a law firm. Maybe studying and working at a library, but that's about it.
