I think people touched on A9 due to the debt/interest going from one bank to another. What did you write for Fla Con Law?
For con law I touched on strict scrutiny phisical disability. I got the religious establishment. Soverign immunity was at the end. Mandatory blood testing failure to refuse medical treatment. Possible DP challenge related to privacy with the gun forfieting for $100. There were a couple EP challanges as well. The right to work or join a union was in there. Off the top of my head thats all i remember writing.

I didn't catch the robbery issue on Essay 1 until afterwards. Ugh. I discussed only second degree petit theft under FL law as it relates to the larceny/robber issue. I do think you should have discussed false imprisonment by the clerk, though, as the call of the question (what was the most serious crime that occurred at the store?) didn't limit the discussion to the crimes committed by the boy.

Essay 2 also had "access to courts" issues and I discussed both free exercise and establishment clause since the statute arguably discriminated against those who didn't "exercise" religion by attending religious services. Maybe that was a stretch though.

The Article 9 issue in Essay 3 related to the sale of the promissory note from bank to bank. I think that was a sale of a right to payment (an instrument, I said), which is automatically treated as a secured transaction under Article 9. I hated this question. I basically focused on FL's notice recording act and homestead for the rest of this question. I am sure I missed some issues.

Sounds like you killed it. Hard for me to get behind false imprisonment, elements don't seem satisfied. Not to mention the essay was criminal. Go to the Fla Bar Outline for criminal. False imprisonment isn't listed, just kidnapping. They really shouldn't test on it, unless it was torts as well. Possession is on outline. Juvenile proceedings. Miranda. Searches. But honestly the robbery could easily be disputed by saying the force wasn't before or during the taking.

Looks like I'm not alone on article 9 ha.

Essay 1: Crim Law/Juvenile Delinquency: Larceny/Theft, Florida doesn't make distinctions between larceny, false pretenses etc. Also robbery, not initially but he used force to leave. Also battery. There were also 4th Amendment issues as well as search and seizure, Miranda Rights issues to discuss. Also discussed "fruit of the poisonous tree" and the exclusionary rule concerning all evidence of the search. He was 16, so this also incorporated juvenile delinquency. Rehabilitation is the focus, as well the juvenile has most normal Due Process rights.

Essay 2: Florida Con Law: How to create a Bill: Issues I discussed were the lack of title of the bill, vague/broad title's are unconstitutional, requires an "Enacting Clause". Bicameral legislature. Spend for the General Welfare. Section 1: Establishment Clause violation by giving time off for religious treatment. Strict scrutiny. Section 2: Mandatory blood testing was an invasion of privacy issue, fundamental right, strict scrutiny. Section 3: Guns- doesn't fit with the rest of the proposed bill, bill's are required to be single issue, no logrolling. Section 4: Access to courts. All sections should apply strict scrutiny test because they implicated fundamental rights.

Essay 3: Real Property: Discussed homestead, quit claim deed vs. general warranty deed, buyer protections. Florida is a notice state, order of priority of mortgages. Tenancy by the entirety, can't take out mortgage without wife's signature. Discussed who the defendants would be, how to enjoin them. This was my longest essay by far.

Florida MC: Florida Civ Pro, Florida Crim Pro, Florida Evidence, and Wills.

MBE: Morning was easier for me, the afternoon had some tricky questions. Felt pretty good about knocking 2 answer choices off immediately but there were some where I felt the questions weren't very clear or either answer was good.

Im glad I talked about homestead, although I dont remember homestead applying to most of the property or sales at issue. Like they were mortgages and so homestead wasnt applicable. In my analysis I mentioned that the one lien could possibly be applicable to homestead and may be invalid, since it already attached and everything. Waiting for your score really sucks like Im just drinking beers and making random forum posts from what I remember about the exam.

I talked about homestead in the 3rd essay and argued that the mortgage to Megabank was invalid because the Wife’s signature was required. I countered with that the Wife standing by idle with knowledge and not doing anything about it could be an acceptance/passive notation. Then I used homestead for excluding Larry’s judgment because it wasn’t a mortgage, tax, or mechanics lien. That essay was a blur. I was just typing and hoping it sounded good.

Doing it "quick" wouldn't be complete (and I'm typing on my cell phone-tiny) I don't want to mislead. You can see My complete answers here: www.thefordmethod.com Its my opinion, how I would answer them, (and my scaled Florida bar score was 159). But, I am not privy to the bar examiner's ideas, or grading rubric. So, take it with a grain of salt. I am sure it's more then "passing".

So there are 6 more days to wait for the scores. Correct??? I remember the proctor saying that the scores would be released on April 15. That is this Sunday.

I failed, 3rd time. Lost a job I really desired. I have to go into work looking again like nothing, only something worthless as I see my co-workers start to practice.

Also failed, 2nd time. Caught me completely off guard since I was only off 8.5 in July and was scoring significantly better this Winter vs Summer. Got a 44% of the BARBRI midterm over the Summer and a 63% over the Winter. Hard to see the light at the end of the tunnel but...

I’ve taken the bar exam every year since July 2015. I just recently failed on my 6th attempt. On my second attempt I was 3 points short, on my 4th, 5 points short. On my 5th, I was off by more than 10. I’m still waiting for my score report.

I’ve employed a bar exam tutor before but was unsuccessful. The study plans were not conducive to my learning style.

I excelled in law school and have never really had a problem with text anxiety or stress. I’ve put the work in and keep coming up short.

As you can imagine, it’s quite disheartening to keep failing. However, I’m willing to fight the good fight again in July. My app is now stale and I have a small turn around time to get everything in.

I need advice, suggestions, bar exam prep ideas? I’ve heard of Grossman...anyone hired him and been successful? Any others?

57.8% pass rate. Is this overall, or just for first time test takers??? The july exam was a 71% pass rate, so this is a bit confusing. From what I understand, there are more first time test takers in July and this explains the higher pass rate. I still havent checked my score!!
