Yea same here. I guess the memorization process doesn't need to really start for a couple weeks after all the MBE lectures are done.

Is there a way to get more MBE questions from themis besides the ones that they give you?

I'm getting the Emanuel books. Going to order those later today. Just got baressays.com subscription and will go through that first this afternoon after viewing some more Torts lectures.

Well, I'm keeping the books because the long outlines on the website are total shit to read. I personally just hate the format they are presented in. I'm also keeping the book so I can do the MBE practice exams on paper when the time comes.

All that being said, I'm not 100% sure whether you need them or not. You paid over a grand for them. What's the harm in putting them in a closet for a few weeks?

Assuming you are following directed study and working on single subject MBEs, I wouldn't worry too much about it at this point. We are still in the learning phase and 34 questions on a single subject are bound to have some serious stumpers. I just aim at the 50%.

The only supplement I've used so far is the adaptibar flashcards. I might get extra MBE help if I can't pull off a decent score on the mixed subject practice exams with Themis.

Try Adaptibar's flashcards. They are also $95 but you don't have to pay shipping because they are totally online. They are great if you're okay with not having tangible cards. Also, for whatever it's worth, you get lifetime access.

I had to laugh when they censored out "god damn" from the last Remedies video. The lecturer stating in a calm voice to "just give me back my god-damn Iron-Man" was hilarious.

So how precise do we have to be when reciting rules for our essays? The model solutions from Themis seems to have verbatim recitations of rules, followed by discussion of facts to law. I mean, in law school we were only required to have a somewhat-accurate recitation of rules, or at times the rule recitation wasn't required at all if you were able to demonstrate your understanding via application of facts to law.

I'm just not a good memorizer, so it's daunting to see the model answers that have paragraphs upon paragraphs of straight up rule recitation...

I wouldn't not how to answer this question, except by saying to look at sample graded bar essays (baressays.com ?). For contracts at least, I seem to be able to find/outline all the issues, but the model answer is always so much more detailed. I doubt anyone can write that much that perfectly in under 1 hour. I would personally just try to get closer to those answer, but remember that we really only need a score of "65" on an essay to pass that essay, whatever that means...

in a related question, how are you guys doing on the MBE's? I'm doing them all timed, but in interactive mode still. I'm getting about 68-73% right on the MBEs (though i Just scored an 83% in prop). I've only done two subjects so far, so I hope I can retain all of this material for the real thing.

that's a really good score congrats!

As for me, I'm averaging like 55% but I think it's because I've neglected to read the long outlines. I'm doing well on the essays however, so hopefully that'll make up for it.

Yeah. I'm hovering around 73% for Property and Torts so far. I was at 65% the last time I did a K's set. I've been told a million times that you shoot up in your MBE scores toward the end once everything comes together. I'm not worried about it yet.

I just finished my graded essay. I won't get it graded for a couple days, so I was hoping I could get an answer to my question sooner.
1. I have read the sample answer and watched the video for the essay. I understand why the answer is what it is regarding the first question (covenants). The part that I do not understand about that question is why do the actions of S as a sub-tenant affect A? I read the question, but the whole time I was wondering "well why doesn't the board just sue S?". I understand S's relationship with A (valid subleasee), but i still do not understand how the covenant runs. More specifically, for the vertical privity requirement, why do we only look at whether the burden runs to A (who didn't do anything) instead of whether the burden runs to S (who broke the rule). Basically, in regards to covenants, are the leasors liable for the actions of the tenants/subleasee? What about the strict vertical privity requirement to run with the burden? When doing the test i remembered that Life tenants are not guilt of this because they did not receive an entire interest in the land, so i imagined the same would apply with tenants-subtenants.

2. Why didn't the sample answer go into the warranty of quiet enjoyment?

Also, i really hate how they want us to focus on the TnC element...we basically skipped that element in property law class.

Yeah. This has been discussed a bunch on the main board. The first sets of MBE questions are really to help you learn the exceptions to the rules. The lecture videos don't go into everything that is on the main outline so you likely won't start shooting up in scores for a bit. I started out in the 50s but am now getting 60-70% consistently once I got into a rhythm with how to study.

As we get closer to the end and are doing mixed problem sets of 50 and 100 the goal will go up to 65%, if memory serves.

To put in some context, I believe that for July 2014 the median scaled score was 141.5, which I think is approximately 65-66%. So about 125 or 126 raw score. This is based off of a few website searches and actual scores I know from that administration, including my own.

FWIW my MBE goal is 75-80%.

Did anyone have issues understanding the hypothetical in CA Remedies lecture #3? It's about the guy, Paul, whose garage and 3-year-old motorcycle are wrecked due to a flood caused by Doug's dumb trees. The professor, and the lectures notes, discuss that the compensatory damages are either $30,000 (the cost to remove the trees) or $10,000 (reduction in the market value of the property).

But the fact pattern gives us info about the motorcycle ($5000 to repair or $4000 to buy a new one). Shouldn't this also be part of compensatory damages?

The professor completely leaves out talks about the motorcycle. So confused!

I think she explicitly said she wasn't going to talk about every part of the question so you could get some more out of it when you come across it later on when doing practice essays. I think there would be a whole separate discussion (header) on if P should have to replace or repair the bike, which I don't think was the point that the professor was trying to make at that point.
