Well that's good, so if their background check form asks for arrests you say no... If it asks for school sanctions and suspension a then you'll have to explain. But I don't think all background check forms ask for the latter, so who knows you may get lucky and not even have to explain it.

Before you go taking responsibility and admitting past mistakes to a DAs office it may be a good idea to consult a defense attorney.

Talk to an attorney who does crim defense work in your jdxn. He may know enough about the DAs office to gauge the risks involved, but at the very least he'd explain to you the applicable laws.

Where can I get such advice?
Sounds like you're still in undergrad, in which case your school likely has an office of student legal services. Make an appointment there to discuss your situation. Personally, I don't see the harm in applying if your only fear is getting rejected because of your past. How is that different from getting rejected for any other reason? Unless you're concerned about some repercussions of discussing the incident, in which case I can't give you advice there and you should go talk to a lawyer.

OK. But what about my school's director of public safety? He said I should apply...he was a police officer...
That's certainly good, but its possible that DA won't be so understanding. Especially a female DA who doesn't work at your school and doesn't really know you.

Just remember, you always have a right to remain silent, and anything you say can be used against you in a court of law, and that the statute of limitations on rape may be more than a few years.
