When to Disclose

I have been given an opportunity to clerk for a state Court of Appeals. When I was much younger (5 years ago) I landed in some legal trouble. I pled to a diversion program and the record was made nonpublic. However, under the provisions of the statute one of the exceptions is when a court is attempting to evaluate whether a person meets the criteria for employment at a court. The form consenting to a background check does not ask any questions regarding history. My question is whether I should wait until the record is discovered by the background check or if I should be completely forthcoming about it and email the judge even before it get's brought up (if it does).

Any advice would be appreciated.

Honesty is the Best Policy. Better be safe than sorry--when they rescind their offer. Just my 2 cents.
