What is the deal on recently confirmed judges? How soon after they are confirmed do they start interviewing and hiring?

Pure speculation, but many judges begin soliciting applications from within their professional circles before they are confirmed. (In another thread, someone mentioned that Judge Jackson on the D.D.C. had hired through 2014 within a week of her confirmation.) I would be shocked if Srinivasan is not hiring for 2013 right now (or has already hired), primarily with some combination of young DOJ lawyers, O'Melveny associates, and Wilkinson clerks. Do not underestimate how many people would be willing to do a second clerkship if it's on the D.C. Circuit.

It is also not uncommon for a new judge to try to find a clerk who has already done time on the court in question, so it could be well that Srinivasan has put out a feeler to current clerks to see if anyone is willing to stay on another term. School range: T25-T35
Rank: top 10%
LR?: yes, board, but not e-board
Published?: yes, casenote
Recs: 3 professors and 1 state judge
2L/3L/Alum?: rising 3L
Where applying?: district courts in the 4th Circuit (where I'm from, went to UG, LS)
Any other factors: no

If judges are following the plan, they can't contact rising 2Ls for interviews until June 28. (If they're scheduling interviews now, they're not following the plan, so June 28 holds no significance.)

Actually not really true. A number of SDNY judges have announced on OSCAR that they'll be using June 28 as interview day--that is, they'll contact 2Ls for interviews over the next few weeks but not interview them until the 28th.

Really dumb question - if I am interested solely in magistrate judges, but I am unable to make my school's deadline for the June 28th date given that it already passed, should I not even bother anymore?

I just now got my spring grades back and did really well (a lot better than expected), and my GPA jumped up a lot. I had been contemplating applying for a clerkship, but after a median fall semester due to health issues, I decided to give up and not bother. Now that my GPA is up again, I'd really like to try for something (magistrate judge or state court) but am worried I am now SOL because of the dumb Plan.

Gotta be to avoid the swarm of 2Ls who work downtown just coming to the courthouse and going door to door.

You have a shot, but are probably less than 50/50 to land something unless you're high up in the top 10%. You have strong ties which is a bonus. Pay careful attention to your applications to judges who have hired recently from your school. Reach out to clerks (current and recent past) who are alumni of your LS. Get some professors on the phone for you. That's your best shot. Good luck!

Didn't know that. Though honestly, that seems fairly silly (if you're not adhering to the plan by waiting till the 28th to contact people, why not just start interviewing now? you're still not following the plan and you're still going to scoop those people who are on the plan.) I mean, I realize you're just the messenger, I just don't get it. :)

FYI, 4th circuit and d.ct. judges in the 4th circuit are actually pretty good in the sense that they seem to hire more regionally. With exception of judges like Wilkinson anyway. But yeah, it could depend where in the top 10% you are; if you're really high up I would emphasize that in the application materials somewhere. "Ranked 5 of 200" or something for example.

I think it's probably best understood as a reaction to the 'new' Plan, which consolidates the dates on which a) 2Ls can send applications, b) judges can set up interviews, c) judges can conduct interviews, and d) judges can make offers. The old Plan set out different dates for those milestones; under the new Plan, all four take place on June 28 (which itself is pretty silly).

Thanks for the links. Yeah, it's a reasonable thing to do given the change in the Plan schedule, but wow, the Plan as it currently stands is so useless. They should just put it out of its misery.

I think it depends on which districts you're targeting. If you're asking about NDCA, SDNY, or the like, your odds are quite slim. If you're looking at flyover territory to which you have connections, you should have a shot. If you apply with a year of experience under your belt and do good work for partners who can vauch for you to district judges, I think your chances rise markedly.
