Questions About the "Compare" Signal

Post by rsox5000 » Thu Apr 19, 2018 4:05 am

Can I use a "Compare" signal to both provide a citation for my rule as well as explain it? For example, should I have [rule] [cite to case X] and then have my "Compare" signal? Or can I just have [rule] ["Compare" case X with case y]? Also, sorry if none of that made sense; I've been working all day and it's currently 4 o'clock and I'm running on fumes.

Probably best to use it in context of comparing the cases relevant to diverging points of law you've already been discussing. If you're just pointing out a conflict or difference of opinions, perhaps "but see" is the best option.

Why not just use a parenthetical?

Example for battery:

A battery can occur even if the victim's body is not touched. [Citation] (finding defendant committed battery when he knocked a plate out of the plaintiff's hand).
