Do a bunch of practice questions. The BarBri practice tests seemed to have prepared me well -- I studied for like four hours on Friday by taking two tests and reviewing what I got wrong. That's the easiest way to learn the rules, at least for me. I passed easily.

The above is exactly correct: you almost never choose the answer that seems "best" or most moral because it is likely impracticable. Narrow down to two, and then choose the less idealistic if you aren't sure.

Stop seriously trying to implement the JOKE strategy of picking the second most ethical choice. That's a recipe for failure. Just do a bunch of practice questions to learn the rules.

TCR. I don't remember many questions even presenting you with a variety of actions, some "more ethical" than others. Often it hinges on why lawyer X can or can't do something. Just learn the rules.

I got the BarBri book, put in about 8-10 hours, and did fine.

It's not a joke, and if you'll notice, I only recommended the strategy if you are down to 2 and really don't know. Maybe I'm amoral or something, but it worked pretty well for me, and I definitely did not crush ProRes.

I think I browsed one test and mainly just did the BarBri study app. I got a 100 and begrudged every point over 87 as wasted time.

Kaplan's MPRE prep is horrendous and actually convinced me to go with Barbri for bar prep. But then again, I still managed to pass with about 4 hours total of studying (watching the Kaplan lecture and doing some practice questions). My score was something like 2 points higher than the minimum I needed in my state. Feels good man, when it comes to minimum competency tests, every point you score above the minimum just makes me feel like I wasted my time.

Gonna confirm the Kaplan sucking part for all the Anons/guests. The BARBRI practice questions (use the phone app, just like kalvano says, it is awesome) are significantly longer and more realistic... Kaplan had way too many 1-2 sentence prompts with simple answers.

That said, I plan to watch BARBRI video in full, take a few PTs, but otherwise chill and get OT at my jerb this week and next week.

If you're fairly bright you can just wing that shit. Plenty of folks don't study and pass 1st time. If you need to pass b/c of the timing with the bar and whatnot, then study for 5 hours and you'll pass.

can anyone explain the situations where there is a conflict and a lawyer either can or cannot be screened out. I know they can be screened out if they go from gov work to private practice or judge to private practice but can they be screened out if they move from one firm to another? what are the situations where you definitely cannot be screened out? I can't seem to find a definite list

GENERAL HYPO: Client has a legit and unquestionably ethical agmt w/you. You guys lose at trial. Client is PO'd, wants to appeal w/new counsel. Client owes you fees.


Kaplan: You can take out a retaining lien in your non-paying client's file, this is an area that can be regulated by state law.


BARBRI: Must give client the files, bring an action for fees if needed.

The right answer on the MPRE is going to be that the client owns the files and they must be surrendered on client's request.
