Dumb question about UCC
Does UCC, Art. 2 apply to sales of goods even when neither party is a merchant? If I contract to sell you my used LSAT books, does that under the UCC?

Re: Dumb question about UCC
The UCC is for any sale of goods and there are special rules depending on whether neither, one, or both of the parties are merchants.

Thanks. That is totally what I thought until I found a website that said it doesn't apply if neither party is a merchant. Turns out that website was from New Mexico. New Mexico's adoption of the UCC doesn't apply to sales of goods between private parties, apparently.
