Torts Exam Organization

Post by jkjd2015 » Sat Dec 08, 2012 12:01 pm

When I organize my answer by party, and A will argue that B was negligent per se and negligent for not following custom, do I make a separate DBCD for each duty, or can I lump them together and discuss causation and damages once?

What about a claim of contributory negligence by B against A?

Will it look like:

D/B - negligence per se, custom, B's claim for contributory negligence
C-
D-

or should they be split up? I think I'm confused on whether they need their own causation analysis.

Thanks ahead of time.
