You don't want to be sleep deprived going into the exam, or while you're taking practice exams.

My test on Wednesday is at 3pm though so I kinda need to change my sleep schedule slightly. On my regular sleep schedule (where I wake up at 9am), by 7pm (when this test will finish on Wed.) I'm tired as fuck. I don't want that to happen on Wed...

Well then work on the outline until like 4-5am and wake up at noon.

If your Civ class is anything like mine, you're probably fine. None of us have a fucking clue what's going on.

I have a feeling that my Civ Pro exam will end up like this as well. Our test is closed book / note and we are also accountable for state civil procedure differences when they are extreme from the FRCP. Joy.

Wow, you must go to a better school than me. My school switches how Civ is taught, so we learn all the stuff about jurisdiction, etc. in Civ Pro II. Basically, we learned about due process, Rule 12(b), discovery, jury selection, and ADR. Her exams are a joke. One of the questions from an old exam: Regardless of its legality, is this an acceptable use of a peremptory challenge? (Answer in 25 words or less). Suggested time: 10 minutes.

10 minutes, to write 25 words, on a yes/no question. We get a full outline, textbook, and a copy of the FRCP. Nobody has even begun to study for this, I don't think.

lol, I don't even know what preemptory challenge is but thats enough time to look it up on wikipedia and go to starbucks

ETA: just looked it up on wikipedia. Our CivPro class does not do jury selection stuff at all.

We spent a whole class doing mock jury selection. And people give me shit for skipping that class.

Our Civ Pro is a 4 credit one semester course, so we smashed everything in. We have everything from PJ and venue to SMJ to discovery to jury issues to appeals. It is going to be a massive shit show.

you guys are funny talking about 7-8 hours of sleep. I am lucky to get 6 most nights. Then again, even when I am not bunkering down I only get 7 max. When I get 8+ I feel like I am wasting time lol

I am spending tomorrow typing out answers to Torts hypos. Taking it some what light on Monday for review and prep. My first exam (Torts) is on Tuesday at 8:30 am. Having all of my exams being closed book is about to cause my brain to explode!

I don't think there is time to look at your books even if they are open book. I had my first exam for contracts last week and the time crunch was unbelievable. It was totally open book but it barely helped me because there's really no time to flip through (at least with my exam). The best thing is to have all the major stuff memorized, whether open or closed book.

Anyone have any tips for a closed book torts exam? I know the professor is big on analysis, but it seems like torts is such a vast topic to not have anything to refer to.

I have tried to make an attack outline to help me memorize those important elements. Proximate cause is relatively simple, as you mention, but there is a lot to discuss to ensure you hit all the points available.

I would be grateful to take a look at anyone's writing on proximate cause and how you handle it in working through the paragraph. Our professor has not provided any sample answers, nor guidance for the exam.

Good CivPro PT just now. Had to negotiate some issues that we hadn't covered in class, but that I've EE'd and outlined on my own. All turned out pretty good looking at the model answer. I snagged 95% of the issues they did in the model answer. I weighted my analysis a little differently on the issues than the model answer and there are still a few places where I need to be better about analyzing according to a formula (SMJ-->PJ --> Venue etc.). Obviously, there's no way to know how these things are actually weighted by the professor.

Anyway, feeling pretty good about CivPro. Tomorrow starts three day crunch time for Torts and then exam on Wednesday. Kind of looking forward to getting to the point in finals time when I can focus on one class at a time, take the final and then put the whole thing away and move on to my next final.

Hm... tomorrow is my final day before before my first final on Monday. Any suggestions on how I should spend it?

I had 7 full days before my first final so the day before, I only read some model answers. Otherwise I made sure to distract myself all day with non-school stuff because I really started getting nervous whenever I wasn't distracted by something. I'd avoid Facebook, etc. where people are constantly posting about how they're either cramming to add more stuff or how they're going to fail or w/e.

Just relax and you'll feel so much better when you're taking the test.
