can damages of 75000 be added between 2 parties?

if P sues A and B, and the combined amount is above 75000, can it be valid?

P sues A (he is their salesman)for breach of contract
P sues B for buying product thru A but never paying P ( the company)

can u add their claims to get 75000 for federal trial?



question 2)

is service proper if given to someone of reasonable intelligence?

I think the rule is the "amount in controversy" must exceed 75,000. So I would say yes- though the amount actually has to exceed 75k.

edit: don't know about service.

You can join the amount between claims but not between parties.
