How can you reconcile Harrington and Webb?(Moral Obligation)

The facts seem to be analogous but the courts come out different ways. Is it a jurisdictional difference or am I missing something (I have something in my notes about an expectation of recompense, but I'm not sure what it means).

Webb was wrongly decided, and the R2d statute based on it isn't followed. The way my professor taught it, the consideration was forbearance of an unjust enrichment claim.
