Hence why I didn't like the traditional issue spotting of torts and crim. At least civ pro and contracts, while tougher, required a little more in depth knowledge of the concepts that will stretch out the curve a little bit. Even when the issues are debatable (e.g. inchoate crimes), the average student by now knows to argue both sides and will get the points. On issue spotters in torts and crim, almost everyone will hit the majority of the issues; the breakdown of the curve comes down to who hit the subtler issues and who had better analysis on the obvious issues.
