did anyone study the 7 factor zubulake cost-shifting test and the rowe 8 factor test? what's the difference? i have that i need to know rowe, but it is nowhere in my notes. apparently i just wasn't paying attention that day.

Torts at 10am tomorrow. 3 Practice exams, ~15 hypos out of Seigel's as well as a load of Multiple Choice down. 3 hours in-class, closed book exam. Let's do this.... I feel pretty confident.

Torts at 9. 2 essays- one is going to be a long ass fact pattern and the other is a policy question. Past exams are a little nuts, but nothing can be worse than my K exam yesterday.

Apparently last year in K the A on the curve got something like a 60% raw score. I'd be more pissed, but that prof was actually an awesome guy.

Tomorrow's a day off for me. Ks on Thursday. I took an old final and got 83/100 points. I know that for her midterm 76 ended up being a B so I feel OK.

Erie q:

my professor gave us a guide to follow when analyzing erie problems, and it starts off with saying erie problems can arise in:

a) diversity cases
b) supplemental jurisdiction
c) removal jurisdicition

I have a flowchart that says it can only come up in diversity cases??

which is right? I have been using supplements to do erie, are there multiple ways to tackle erie issues or do they all achieve the same end result?

also - I hate civ pro, I will make my kids read civ pro books when they are bad

Supplemental means there's some diversity involved just not for the particular account, so it's still sort of diversity. Removal jurisdiction requires SMJ anyhow, which could be federal question or diversity, so it could come up in some removal cases. They're all sort of just different flavors of diversity, if that makes any sense.

erie comes up whenever a federal COURT has to decide a state law question.

the question is do we apply state law or is there federal law we can apply, i.e. fed statute/FRCP a la hanna track or go the Erie track and do an erie analysis and modified outcome determinative test and byrd balancing.

It's a trap like all the TLS guides have mentioned. I wanted to give people the benefit of the doubt and try to bounce ideas off one of another to learn the material throughout the semester, but the people I study with were so flaky all semester and can't pull their shit together. I gave up trying to coordinate with them a month ago, but sometimes when they ask me questions that I think they should have asked/ we should have talked about a month ago, I get really pissed. Study groups are a time sink, like everyone else has said on TLS. I believe it now.

A couple of classmates invited me into a study group and I accepted initially thinking it would be a good idea. But I reneged later just because I found that the more I isolated myself from the LS social giggles and whatnot, the more centered I was and felt like I understood the subject matter better.... Well, lets hope I learned it all well.

Yeah, in the last month or so when I stopped trying to coordinate with them, I've been way more productive. I mean, it was getting ridiculous to the point where they'd ask me to e-mail a 3-week schedule to them so that THEY could be on track. What am I, their secretary??

Ks tomorrow, but all my exams are at 2PM. I'm lucky like that, but unlucky in that I am sorely unprepared.
