So your friend engaged in the unauthorized practice of law and fraudulently held himself out as an attorney without being admitted to practice. You do realize that this is a serious ethical violation that can be grounds for his not being admitted to practice. Cool story though.

Not only is it a violation to represent yourself as an attorney when you are not licensed, but it is also unethical to claim to be a specialist unless you do in fact hold such a certification.

I'm almost tempted to get the name of this lawyer err student and inform his school/state bar of the fact that he deems himself ready to practice after a few weeks of 1L. I recall that when I sat for my character and fitness interview, I was extensively questioned on whether or not I had ever signed a document for my law firm employer without being sure to indicate that I was a law clerk and not an attorney. Apparantly, Bar examiners take shit like this very seriously.. He even went as far as to sign it JD.. I mean come on.

Errr, I'm going to reserve judgment on him. He's a good guy and ethical issue aside, even though two wrongs don't make a right, he got his money back.

Maybe the law is a big joke to everyone else, but now that I have studied the AMA Model Rules, I know that not only is the OP's story a violation, but it is a violation for an attorney who knows about this to fail to report it. I'm not saying I think it should be reported. I'm saying you don't know what you're talking about though.
