withholding W2 form

the shit law firm for which I worked last summer wilfully withheld my w2 form so that i was not able to file tax return. I reported to the IRS and finally got all the tax return in June/ July.


Is it a federal offence not to send the W2 form to employees or past employees?

IANAL, but I have done the whole "mail out W2's to the quitters" for a business, not a firm. They can claim it was mailed. Maybe it was - I believe it's an offense if there's intent behind it.

If they mailed it out and have delivery confirmation proof, you're going to look like a major jackass.

i believe the shitty people were being passive aggressive.
I sent several emails to them politely asking for the W2 form but got no response at all. If they had mailed it out they should at least have responded.

Illegal? Probably not - if it really irked you that much.. talk it over with a lawyer or a law prof maybe?
