It's a COMPLETELY open book open note even open google (as long as we don't communicate with anyone) exam with a 2k word limit and 4 hours.

If I don't know it going into the test tomorrow, I'll have time to figure it out.

i wish i could help but i insta deleted everything from erie about my mind after i left the exam room (and the erie question on the test was seriously the easiest thing ever... a federal judicial practice in conflict with a really important state law)

Yea I just get confused on what one to use. Pisses me off. Let me know how that checklist works out - I start studying for Conlaw tomorrow and will need to get a checklist together (especially for all of the possible legislative justificaitons for enacting a law) I seriously feel like I dont know a thing about con law but am trying to not think about it yet.

Here's the rough outline I used for Erie questions, which is sort of set forth by combining Hanna/Gaspierini.

1. Does a federal rule govern? If no, move to Erie considerations of forum shopping/inequitable administration of justice
2. If a federal rule governs, does it conflict with state law? If it doesn't conflict, move to Erie considerations
3. If it conflicts with state law, does the rule mesh with the Rules Enabling Act/constitutional/etc.? If the answer is no, the federal rule cannot be applied, move to Erie considerations.
4. If the federal rule meshes with the REA, perform the Byrd balancing test between the state policy behind the law and the federal interest in following the federal rule, see if it is rationally procedural, etc.

Ack shiiit. I just woke up with an awful sore throat and I have admin on friday which requires my brain to be functioning at a higher not lower than normal speed. Anyone know any way to get rid of a cold FAST. They always knock me out for a week and I do not have time for that right now...

You can't trust your post exam instincts. The curve, self doubt, adrenaline... whatever your instincts are (and they won't always be wrong) you still can't trust them. Just move on (to drinking, studying, or study-drinking depending on your circumstances).
