First exam of the semester tomorrow, Contracts 2.

Quick question if anyone is around:

A agrees to build a boat for B for $5 Million to be delivered on May 1. B needs the boat to ship a crop that will rot if not shipped by May 1. A is 100 days late, so B rents 3 ships to deliver the crop. The total loss to B is $200,000.

Study group is currently arguing over whether the $200,000 would be expectation or consequential damages.

Any help?

Consequential--expectation is the difference between what was promised and the value of what was received. $200k was his loss and flows from the breach, which he will try to pass onto A if it was reasonably foreseeable and quantifiable. That doesn't mean he will get them though.

Seriously, fuck the CALI for crim law. When prompted with "what must a self-defender assert to justify use of deadly force?" I typed, "an imminent threat of death or serious bodily harm," but I was incorrect. CALI wanted, "a threat."

Jeez, I live ~1,000 miles from the theater district, and I've seen it, um, four times! Haha, it's the only show I've seen more than once, though; it's just that the original cast is absolutely incredible. The show is seriously the most powerful one I've ever seen, and it completely defies 'conventional' Broadway. Please see it and report back :)

I always thought Fordham was on the mainland of New York state for some reason.

That's our Rose Hill campus. Fordham Law is at Lincoln Center, directly across the street from that other place I can't go, aka the Metropolitan Opera House.

General trend:

1) You know whether or not you put in the needed work, if you didn't then you're hosed. No getting around that.

2) If you worked at least as smart (hopefully not as hard since you know better now) as last semester, then the higher your grades were the more likely they are to be in that neighborhood. Top 15% or so means you got some median or below grades first go around, or at least that not all of your exams were at the top of the heap. But if you were pulling down As last semester you aren't going to forget how to do it.

General trends, obviously, mean less than particulars - but absent giving up or letting ego get in the way of doing the work, high performers tend to have two things in common with respect to second semester grades. First, they panic and get terrified they'll lose their spot. Second, they don't.


I hope this holds true. I definitely did less work in the casebook but feel I know the subject matter so much better already than I did going into reading period last time. The funny thing is, I have the same exact feelings as the first time around. (Everyone here is as smart or smarter than me, everyone here has studied as hard or harder than me, everyone here knows the material as well or better than I do, everyone has the same materials/study methods/exam methods). You would think that killing first semester would give me some confidence. I am not sure it has at all.

tbh I realized 75% of the work I did last semester was a complete waste of time, and I only did the 25% I found useful this time and spent more time refining general exam abilities (nothing course specific).
