The bottom line is that you are most likely fucked. I would not recommend that ANYONE with ANY grade/law school combo go (entry level) into patent lit without a tech background.
TT people won't want you because you don't have a tech background.
In house won't want you for the same reason.
Your best bet is to do some other kind of lit, but LOL @ the prospects of general commercial litigators these days. Sorry, bro, but you're kinda hosed.

The big V20 firms always try to get the huge patent cases (like the IV cases and Apple/Samsung type shit) so they can throw all the non-tech people on massive doc review projects, letter writing campaigns, ROG drafting, unnecessary depos, unnecessarily detailed motions to seal, huge and unwieldy pre-trial designations and other bullshit that churns the bill. Boutiques do smaller cases that require surgically precise technical analysis (especially when reexams and IPRs are involved) but without as much discovery bullshit.

I don't have a tech background and I'm not a full-time patent litigator, but I do some patent litigation, including invalidity and non-infringement. It's tougher on the EE patents than on the "computer science" patents.

I don't have a tech background and I'm not a full-time patent litigator, but I do some patent litigation, including invalidity and non-infringement. It's tougher on the EE patents than on the "computer science" patents.
We definitely wing it to a large degree, but the tech background helps. I think mostly I'm just confident that if I spend time, I can learn it.
Software patents are such garbage.

If you think firms are winging it, imagine what district court clerks and judges (with zero formal training) are doing when they author invalidity or infringement opinions. Jaja fed circuit but more action is happening at trial level

My firm doesn't do Hatch-Waxman, mostly EE and some biotech/devices. How easy to lateral to a life sciences group? No advanced degree but have 5+ yrs IND/NDA lab experience.
