NALP, to which most of these firms belong, begs to differ.
NALP "guidelines" are exactly that: guidelines that neither I nor firms have any obligation to follow. Are you going to scold judges for not following the OSCAR hiring plan too? I didn't experience a moment of doubt asking for a cold offer when I was told that my work product was excellent, but one associate didn't like my personality.

We're talking about ethics here, not laws. There is plenty of unethical shit that is completely legal. I did not say that firms could not cold offer, I merely responded to your claim that it was not "unethical."

I'm also not disagreeing that the best thing someone should do is ask for a cold offer. I'm just saying that actual cold offers (where firms give an offer to return but highly suggest you go elsewhere) are considered unethical by NALP. I'm also going to agree with bils that a cold offer where it is not an actual offer but rather a lie that your employer backs up is straight up fraud.
