At this point, it seems probable that the judges on the hope list were either not hiring 3Ls to begin with, or have not made calls. Let us see if we can narrow it down further. One way is to consider those judges on the list that accepted applications on Oscar: Melloy, Riley, Barkett, Kleinfeld, Cook, Siler, Vanaskie, and possibly others (let me know). In addition, consider the judges who have a reported history of late offers: Vanaskie, Rawlinson, Hull, Fay, and possibly others (let me know). Vanaskie appears on both lists. Together, there at least 10 judges out of the 32 who have probably not made calls.

There probably isn't much hope for Carnes - I know he's filled at least 3 slots, and he interviewed someone in my summer class for the fourth in March.

For the more competitive districts and for COA? Sounds like most have called, but not all. For the less competitive districts, particularly DCTs and magistrates in the heartland, I'd guess the majority haven't even made calls yet based on what I've heard ITT and from CSO.

By all accounts, calls will continue for weeks and even months. Some judges don't even hire until the winter or spring. Obviously the plurality make calls in the first week, and with each passing day there will be fewer open slots, but there isn't some magic day when calls just stop completely.

In what may be the least surprising news on this thread, Easterbrook is done hiring for 2013, per a parlay call to chambers.

Is anyone clerking/applying to clerkships that doesn't really want to do it? I applied to three judges and got two interviews (Southeast/Mid-Atlantic), but I don't know that I actually want to clerk. I would like to be a professor in the future, but I would prefer just to go to my firm after graduation as opposed to clerking. The firm is willing to defer my start date until after a clerkship and has actually been very encouraging of me doing a clerkship. My grades are good (top 15% at a T1) but not great, so I don't think I would be able to pull off the professor thing without clerking. If I get an offer to clerk, I'll do it, but is it worth it (in terms of prestige, future benefits, etc.) if it's not something that I truly want to do? Should I just suck it up and deal with it for a year (if I even get an offer)?

I've heard that clerking is becoming less and less of a prerequisite to becoming a professor. But if that's what you really want to do, you should probably clerk as you have an uphill battle coming from a non-T14 (hell, a non-HYS) school.

If you want to be a law professor—which is a longshot for anyone, even those from top schools with top grades—a single district court clerkship likely won't matter. You need to publish, publish, publish. Schools are looking for an impressive publishing record. If your clerkship would require fewer hours than a big law firm (and thus leave you more time to write law review articles), then I guess it could help indirectly. But unless your judge is an elite COA judge or a Supreme Court justice, I wouldn't do a clerkship just because you think it will significantly improve your odds at becoming a law professor.

As an alum with both district and circuit clerkships who seriously considered the academic route and spoke to many professor-advisers about it, I agree with this advice in part and disagree in part:

- I agree that being a law professor (or at least, securing a solid placement) is a long shot, even with a top school and top grades.
- My HYS professors told me that committees would not care very much about my district court clerkship (i.e., it would be marginally helpful at best), but would view my Ninth Circuit clerkship very favorably. Obviously, my lack of a SCOTUS clerkship would put me outside the first tier of academic candidates. However, I respectfully disagree with the above-quoted advice to the extent that it implies that a circuit clerkship is completely optional or that it must be "elite" to improve your odds of an academic placement. This is because a number of my professors told me that circuit clerkships were valued by virtually all hiring committees (even if not for a feeder judge) and viewed as a baseline, necessary credential by many committees. I strongly urge you to prioritize securing a circuit clerkship - or at least to discuss with your professor mentors how important they believe it is to clerk at the circuit level before abandoning the prospect of doing so. This is especially true because it does not sound like you are at a T14 school, let alone HYS, so for you it will be all the more important to "signal" hiring committees that you are a sufficiently elite candidate. I'm not saying this because I am elitist - but because the hiring committees are. (In fact, one of the reasons I personally decided against academia is that I was unimpressed by their obsession with credentials, even though I have many of the credentials that they value.)
- I agree that the most relevant criterion for an academic placement - beyond generally having a sterling resume - is publications. You must make time to write these. You may find that you don't have sufficient time during either your clerkship or firm placement, especially if you clerk for an active judge. In this case, you should make use of the postgraduate fellowships available to aspiring law professors, such as the Climenko at HLS and the Bigelow at Chicago. Those types of fellowships are intended to pay you a living stipend (50-65K) while allowing you time to write, usually in exchange for helping to teach the school's LRW classes. However, they are sufficiently competitive that most candidates who are seriously considered already have postgraduate law review publications (i.e., something more than a student note).

Also: why don't you want to clerk? Clerking is a wonderful experience - and honestly, most aspiring law professors tend to enjoy clerking much more than practice. The work you do during a clerkship is relentlessly substantive, and at the appellate level, you are working on the types of cases about which you'd want to write as an academic. If it's about the money - well, going the academic route is going to require some financial sacrifices - see above note about fellowship salaries.
