ABA 20 Hour Work Rule

Do internships for credit count towards the 20 hour work max? I have been asked to stay on for the fall at my midsized summer firm. The practice area is niche and its okay, but i dont LOVE it. I also got an offer from SEC for fall (and i love securities and have lots of experience in it - so would be able to market myself), but obviously cant turn down firm since it can lead to permanent offer.

I want to do both, and it fits my scheudle, since I'd be getting 4 credits from SEC. Can I do both? I know i need to ask CSO, but they are taking too long and I need to know ASAP.

no, unless your school has its own rule.

generally, volunteer work/internships/etc. don't count. just paid jobs.

I believe the 20 hour rule is a regulation enforced by the ABA upon the schools, but not enforced upon students of schools. The schools technically should enforce this on the students, but I've never heard of this rule being enforced by schools.

Also, it is questionable whether this rule would survive a challenge for being an unreasonable restraint.

The SEC job would not count toward the 20-hour rule.

And yeah, no one pays attention to the rule anyway.

How is this rule typically treated by biglaw firms re SAs who continue to work throughout the year?

My school, a t20, had the exact ABA language in their policies. You should make sure it is not against your school policy. That being said, I have never heard of it being enforced or even questioned. Although I did tell my firm that I had a 20 hour cap during the semester to make sure the job did not become a full time commitment. 20 hours is significant if taking a full course load.

No one enforces ABA rules, not even the ABA. I asked my cso who enforced the "1Ls can't send resumes until Dec. 1" rule and they said talk to the office of student affairs. I went there and student affairs said to ask cso.
