I definitely think that it would imply you'd attend if you were accepted. I'd wait to throw any scholarship conversation at them until they have extended you an offer. That would be like me trying to get a date with the best looking girl in the room, being told, "I'll think about it" and then me replying "okay, I still want to take you out, but the only way I'll still do it if you change your mind is if we can go bowling with Jesus and Liam.".

I definitely think it's okay to send a LOCI even though you don't have anything new to report. Now, I would be careful about subsequent communications that don't involve a question or update, however.
