Do you need UG Diploma when applying for schools?

Hey all, I'm hoping to apply this cycle and I had a question about the predicament I'm in.
To explain, I "graduated" from university in June of '11 and was expecting to receive my degree in the months after - pending one of those degree audits/course checks. A few months went by and I didn't receive my degree so I contacted the school office and they informed me that I wouldn't be receiving a degree. Turned out that two classes I took at my CC weren't counted as transferrable to my University credits and I was 8 units short (172/180) of receiving a diploma. The office told me that I could take any two lower division courses at my CC that were transferable and I would receive my diploma. Problem was that at the time I had been working full time and living on my own at that time (money/time was tight) so I put it off. I moved back home a short while ago in order to study for the LSAT full time so I plan on taking the classes this fall.
Now the problem is that the classes end in December (grades come out maybe a couple of weeks after) and I don't even know if my Uni will do another degree audit/check so it might be a while before I receive my diploma. I really want to apply as early as possible in order to maximize my chances. So, I was wondering if I can apply in November with the grades I have now or if I have to wait for my undergraduate work to be finalized?
