Character and Fitness Addendum

Some schools only ask have you ever been convicted of a crime, in which case I only have to disclose the DWI, but others ask "Have you ever been charged with, accused of, any crime, even if found not guilty or charges were dismissed".... with a list like this, even though they all resulted in not guilty or dismissed charges, do you think most schools will consider me or should I just apply to the ones that ask "have you ever been convicted?"...also any advice on rewording this would be greatly appreciated!


In 2003 I was charged with making graffiti, possession of graffiti instruments and criminal mischief in Southampton, NY. A classmate had been caught vandalizing a truck the night earlier implicated me to avoid trouble. Although I was never found to be in possession of any type of graffiti instruments or involved in any type of vandalism, my lawyer advised that I agree to stay out of trouble for 6 months in exchange for having the charges dropped. I did so and all charges were dismissed and the matter was sealed.

In 2006 I was with a group of friends in Central Park of New York City when undercover police officers randomly stopped and frisked us. Upon not finding anything, I told them that they had not had probable cause and they said, “Who do you think a judge is going to believe?” and issued all of us marijuana citations. This happened twice at the same place and with the same officers, both tickets were dismissed in the mail days later.

On November 16, 2007 I received a DWI in Greensboro, North Carolina upon blowing a .09 reading on a Breathalyzer. I was initially charged with possession of less than a half-ounce of marijuana and possession of paraphernalia as well, however these charges were dismissed when the other passenger in the car admitted they were his. I completed 40 hours of community service and paid a fine. I learned from this irresponsible mistake and go out of my way to ensure that others don’t make the same error.

On June 6th, 2011 I was charged with delivery of marijuana within 1000 feet of a school, 2 counts of possession of marijuana, and delivery of marijuana for no consideration, in Gold Beach, OR. At the time I was a registered medical patient, using marijuana to alleviate pain and anxiety from multiple burns and skin grafts under the recommendation of my physician, and in place of the addictive opiates and anti-anxiety pills to which I was prescribed. The police officers did not understand the medical laws, I pled not guilty, and the District Attorney dismissed all charges prior to trial. (I had less than an oz of marijuana and 1/4 oz of concentrates, all in dispensary packaging, despite how bad the charges sound)

Depends where you want to practice/take the bar. The schools only ask you this to make sure you are eligible to sit the bar in their state. I would not worry about the wording of the questions on the application itself, just be honest in your addendum and if you're still concerned you may have to look up the requirements for sitting the bar in the states you want to practice.

Doesn't sound like you've ever been in serious trouble, more bad luck and AdComms should see it the same way if you present it like that. Hope this helps.

Doesn't sound like a huge deal. Did the school you are applying to specifically ask for any type of run-ins with the law. If so what school?

About 3 out of 4 schools ask if you have ever been accused of a misdemeanor or felony, regardless of the outcome. USC and Santa Clara asked if you have been convicted, UCSD, Chapman, and USF all ask if you have been accused.
